The petitioners apprehend their arrest in Motihari Town P.S. Case No. 93 of 2017 registered for the offences punishable under Sections 366(A), 372, 375 and 34 of the Indian Penal Code.

The informant filed complaint case on the basis of which the present FIR was lodged. The informant alleged that his sister became traceless from the hospital but, later on he came to know that the accused persons kidnapped his sister. Learned counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.34842 of 2017 (3) dt.11-08-2017 occurrence took place on 15.12.2016 but the complaint was filed on 17.02.2017. The victim appeared and made her statement under Section 164 of the Code of Criminal Procedure. The victim disclosed that she voluntarily left her house and solemnized marriage with Md. Parwej Alam. She further disclosed that her parents lodged false case against all the family members of Md. Parwej Alam.

Considering the facts aforesaid and the fact that the petitioners are family members of Md. Parwej Alam, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in Motihari Town P.S. Case No. 93 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
