Petitioner is in jail custody since 24.1.2014 on the accusation that one country made katta and one live cartridge were recovered from his conscious possession when he along with others were caught along with victim of kidnapping.

Admittedly, present case has been registered for the offence of the Arms Act and except prior to institution of this case, only one case was registered against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Bela P.S. Case no. 20/2014.
