Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners, at the outset, seeks permission to withdraw the anticipatory bail application with respect to Petitioner No. 5, Ajay Singh.

Permission is accorded.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379 and 506 of the Indian Penal Code. 5.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.49685 of 2024(2) dt.20-07-2024 2/2 Petitioner Nos. 1 and 3 have antecedent of one case, petitioner No. 2 has antecedent of three cases and Petitioner No. 4 has antecedent of two cases. It is next submitted that from perusal of allegation as alleged in the FIR, it would manifest that specific allegation of assaulting the informant is against Ajay Singh and Dharmbeer Singh. It is further submitted that even the injury suffered by the injured is simple in nature.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioner Nos. 1, 2, 3, and 4, abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Giriyak (Katrisarai) P.S. Case No. 163 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
