The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 36, 41(a) of Bihar Prohibition and Excise Act.
Total 2646 liters of illicit foreign liquor has been recovered from two vehicles.
It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the vehicle in question. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.
Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the
Patna High Court CR. MISC. No.47021 of 2022(2) dt.21-10-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge 1st, Bhagalpur in connection with Kharik P.S.
