2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Babubarhi P.S. Case No. 275 of 2023 instituted for the offence under Sections 498(A), 341, 323, 379, 504, 494 and 34 of the Indian Penal Code.

3. As per allegation in the FIR, informant was married to the petitioner in the year 2013 and out of their said wedlock, two children were blessed. It is further alleged that petitioner and his family members started to demand Rs. 10 lac as

Patna High Court CR. MISC. No.49888 of 2024(4) dt.27-02-2025 2/3 additional dowry. They started torturing her for non-fulfillment of dowry demand and ultimately they ousted the informant with her two children from her matrimonial home.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the informant and has been falsely implicated in this case. He has never demanded any thing from the informant or from her family members. Petitioner is employed in Bihar Govt. as constable and posted at Gopalganj. Informant has filed the maintenance case against the petitioner bearing M.R. No. 214 of 2023 on 21.7.2023 and since then he is complying the order of Family Court, Madhubani and regularly paying Rs. 14,000/- per month in the informant's account for maintaining his wife and two children. FIR has been lodged after 11 years of marriage. Having heard learned counsel for the parties and considering the submission made on behalf of the petitioner, this Court is inclined to enlarge him on bail.

The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Babubarhi P.S. Case No. 275 of 2023 he will be enlarged on bail on furnishing bail bond of Rs.
