The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
The informant alleges that the accused persons, including the petitioner, assaulted the informant and his family members and when injured were taken to the hospital, the accused persons reached hospital and again assaulted and the reason for the occurrence is that petitioner had taken loan of Rs. 50,000/- from the informant and when informant requested to return the same, the occurrence took place Learned counsel for the petitioner submits that the

No.46304 of 2022(2) dt.26-09-2022 2/3 petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that from the side of the petitioner Karpi (Shahar Telpa) P.S. Case No. 216 of 2021 has been instituted against the informant and others. Learned counsel submits that the uncle of the petitioner was brutally assaulted and he was taken to A.I.I.M.S., Patna, it is also submitted that the injuries suffered by the side of the informant is simple in nature as would be evident from paragraph '10' of the anticipatory bail application, it is thus submitted that the side of the informant were the aggressor on account of which the uncle of the petitioner was brutally assaulted leading to his hospitalization at A.I.I.M.S. (Annexure3 series to the anticipatory bail application). Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the
