====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-07-2017 Heard the learned counsel for the petitioners. The petitioners seek anticipatory bail in connection with Belhar P.S. Case No. 73 of 2017, registered for the offence punishable under Section 92 of the Indian Penal Code. It has been alleged by the informant that while he was returning after collecting loan amount, some of the accused persons stopped his motorcycle and assaulted him as well as took a sum of Rs. 89,072/- and mobile phone from his pocket and fled away.

The learned counsel for the petitioners submits that the petitioners are innocent, no such offence has taken place and they have been falsely implicated in the case. It is further submitted

Patna High Court Cr.Misc. No.32586 of 2017 (2) dt.13-07-2017 2/2 that no recovery has been made from their possession or from their house and have clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant anticipatory bail to the petitioners.

Accordingly, in the event of their arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Banka, in connection with Belhar P.S. Case No. 73 of 2017 subject to the conditions laid down under Section 438(2) Cr. P. C. (Mohit Kumar Shah, J) BTiwary/- U T
