The petitioner apprehends his arrest in Malsalami P.S. Case No. 169 of 2022, registered for the offence punishable under Section 30(a)/36 of the Bihar Prohibition and Excise Act, 2018.

Total 5 litres of country made liquor has been recovered from a Jhola which is allegedly thrown by this petitioner who managed to flee away after seeing the police party.

It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open place.

Counsel for the State vehemently opposed the bail application and submitted that petitioner has got one criminal

Patna High Court CR. MISC. No.46783 of 2022(3) dt.09-12-2022 2/2 antecedent of similar nature.

Considering the criminal antecedent, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
