====================================================== CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 15-07-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 137(2), 140(3) of the B.N.S.

3. The case of the prosecution is that the petitioner has kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that from perusal of the order of learned trial Court, it transpired that learned trial Court has recorded her statementunder Section 183 of the BNSS and stated that she had gone to Punjab with the petitioner of her own free will and had married him. No.47210 of 2026(2) dt.15-07-2026 2/3 submitted that the statement of the victim goes to show that the petitioner did not kidnap the victim and that the victim had accompanied him voluntarily. It is further submitted that the learned trial Court has relied upon the School Leaving Certificate of the victim, according to which her date of birth of the victim is 03.05.2009. Learned counsel contends that the School Leaving Certificate is not a valid document for the determination of age under Section 94 of the Juvenile Justice (care and Protection of Children) Act. It is further submitted that from perusal of the medical examination report, it transpires that the doctors have assessed the age of the victim to be between 18 to 19 years. It is further submitted that it is a case of romantic relationship between two majors. Moreover, the petitioner is languishing in judicial custody since 10.04.2026 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Keoti P.S. Case No. 24 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two
