The petitioner seeks bail in a case registered for the offence under Sections 30(a)(b)(c)(f), 37 and 41 of Bihar Prohibition and Excise Act.

120 liters of spirit and 240 empty bottles of wine have been recovered in village Chakki and the apprehended person disclosed the name of petitioner and others, who fled away from the spot.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got one criminal antecedent of similar nature and he is in custody since 15.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

No.58734 of 2021(2) dt.17-12-2021 2/2 Considering the fact that petitioner has got one criminal antecedent of similar nature, the learned court below, where the case is pending, is directed to release the petitioner on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahindwara P.S. Case No. 120 of 2020 after framing of the charge.
