2. The petitioner is in custody in connection with Mali P.S Case No. 75 of 2025 registered for the offences punishable under Sections 25 (1-B) a/26/35 of the Arms Act.

3. As per First Information Report, huge quantity of arms and ammunition were recovered from the house of coaccused.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner. It is next submitted that co-accused has already granted bail by the Co-ordinate Bench of this Court

Patna High Court CR. MISC. No.46091 of 2025(2) dt.31-07-2025 2/2 vide order dated 14.07.2025 passed in Cr. Misc. No. 39575 of 2025. It is also submitted that petitioner is in judicial custody since 15.04.2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that name of the petitioner transpires from the statement of co-accused. Similarly situated co-accused has already granted bail by the Co-ordinate Bench of this Court vide order dated 14.07.2025 passed in Cr. Misc. No. 39575 of 2025.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Mali P.S Case No. 75 of 2025, subject to condition that petitioner shall present physically each and every date fixed by the trial Court till conclusion of the trial.
