The petitioners have prayed for bail in connection with Jandaha P.S. Case No. 310 of 2018 registered for the offences punishable under Sections 147, 148, 149, 302, 307,
Patna High Court CR. MISC. No.38347 of 2019(3) dt.11-09-2019 2/3 326 and 384 of the Indian Penal Code, Section 27 of the Arms Act, Section 3 of the Explosive Act and Sections 13, 16, 19 and 20 of the U.A.P. Act.
As per allegation in the FIR, 9-10 unknown accused persons, covered their face with cloths, are alleged to have shot multiple times on the brother of the informant, who died on spot.
It is submitted by learned counsel for the petitioners that FIR was registered against 9-10 unknown accused persons. The name of the petitioners transpired in course of investigation in the confessional statement of one Ritu Devi, who has stated that during commission of alleged crime the petitioners were keeping a watch on the road The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the fact that petitioners are ladies and are in custody since 11.03.2019, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.
