JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-08-2024 The present writ petition has been filed seeking the following relief:- "1. That the petitioner craves indulgence of this Hon'ble Court for issuance of an appropriate Writ in the nature of Mandamus commanding the Respondent Nos. 6 to 17 to remove the encroachment made over Khata No.85, Plot Nos. 82 and 205, ad-measuring an area of 1.7 acres situated at Mauza-Trilokpur, P.S.-Kargahar, District-Rohtas, which is a public land, which is way of general public."

At the outset, the learned counsel for the RespondentState submits that the Circle Officer, Kargahar, District-Rohtas, has already initiated encroachment proceedings, vide Encroachment Case No. 3 of 2024-25 and the same would definitely be concluded within a stipulate time frame. 3.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle Officer, Kargahar, District-Rohtas, to conclude the proceedings of the aforesaid Encroachment Case No. 3 of 2024-25, if the same has not yet been concluded, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a

Patna High Court CWJC No.10170 of 2024(2) dt.06-08-2024 3/3 period of six weeks of receipt / production of a copy of this order.

Accordingly, the present writ petition stands disposed off on the aforesaid terms.
