Apprehending their arrest in Bathnaha P.S. Case No. 141 of 2017 registered under sections 147, 148, 149, 341, 323, 307, 302, 379, 504 and 506 IPC and section 27 of the Arms Act, , the petitioners pray for grant of anticipatory bail. It is alleged in the FIR that 05 accused persons armed with fire-arms opened indiscriminate firing injuring the brother and father of the informant. The father later succumbed to his injuries. The accused persons along with co-accused Satya Prakash was seen standing on the bank of the pond armed with a Lathi.
It is submitted that there is no injury to any of the
Patna High Court Cr.Misc. No.33724 of 2017 (2) dt.20-07-2017 2/2 deceased(s) caused by hard and blunt substance. Co-accused Satya Prakash has since been granted the privilege of anticipatory bail under order dated 13.07.2017 passed in Cr. Misc. No. 31866 of 2017.
Counsel for the informant, after going through the impugned order and the allegation, is not disputing the contention that the case of the petitioners is similar to the co-accused Satya Prakash.
Let the petitioners named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi In Bathnaha P.S. Case No. 141 of on condition that one of the bailors of each of the petitioners shall be their own/close family members. As soon as the charges are framed, the petitioners shall personally appear in the court concerned on each and every date fixed thereat.
