====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and the State.

Petitioner lady is in jail custody with effect from 03.05.2014. She has made accused in a case under Section 363/366A of the Penal Code as her son eloped with the daughter of the informant. The victim girl has been recovered, has recorded statement under Section 164 Cr.P.C. in which she has said her age to be 15 years, solemnized marriage with the son of the petitioner out of her own volition.

Without going into the correctness or otherwise of the aforesaid contention, only appreciating the fact that son of the petitioner is in

Patna High Court Cr.Misc. No.39558 of 2014 (4) dt.21-01-2015 custody and no overt act has been alleged against the petitioner in the 164 Cr.P.C. statement, petitioner, named above, is directed to be released on bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Sri Jitendra Kumar, Judicial Magistrate, 1st Class, Purnea in connection with K. Nagar P.S. Case No. 50/14 (G.R. Case No. 513/14).
