The petitioner apprehends his arrest in connection with Special Case No. 5445 of 2020 arising out of Digha P.S. Case No. 95 of 2020 registered under Sections 30(a), 32(1), 32(3), 41(1) and 41(2) of Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the driver of the alleged vehicle has not said anything regarding the involvement of the petitioner in the present case. Petitioner has no criminal history.

Case No. 95 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
