The petitioner is in custody in connection with Bihar P.S. Case No. 257 of 2014 for the offences punishable under Sections 406.420 of the Indian Penal Code.

The allegation against the petitioner is that he has misused the A.T.M. card of the informant.

The learned counsel for the petitioner has submitted that there is no allegation that the petitioner has withdrawn the money of the informant and the only allegation of misuse of A.T.M. Card which is also not established when the informant out of his own will had given his A.T.M. card to the petitioner.

Patna High Court Cr.Misc. No.38935 of 2014 (2) dt.14-01-2015 Considering the facts and circumstances of the case and the submissions on behalf of the petitioner, let the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 257 of 2014.
