1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Rajpur P.S. Case No. 195 of 2023 dated 27.05.2023 registered for the offences punishable under Sections 120(B), 414 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.
3. The main submissions advanced by the learned counsel for the petitioner are that though as per allegation this petitioner was apprehended with co-accused persons but no incriminating material was recovered from his possession and the firearms were allegedly recovered from the possession of other co-accused persons and petitioner has fair and clean antecedent and has been languishing in jail since 27.05.2023
Patna High Court CR. MISC. No.47627 of 2023(2) dt.01-08-2023 2/2 and he is a student and making preparation of competitive examinations and against him the investigation has been completed. Further submission is that the seizure list witnesses are members of police party.
4. Learned APP appearing for the State opposes the bail prayer.
5. Considering the above submissions and mainly petitioner's young age, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Rajpur P.S. Case No. 195 of 2023 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
