In this case, the petitioners are apprehending their arrest in connection with K. Nagar P.S. Case No. 30 of 2017 registered for offences under sections 363, 366A, 34 of the Indian Penal Code.

An allegation has been made that one Nirmal Mandal with the villagers has taken away the daughter of the Complainant who is aged about 16 years with an intention to enter into the marriage.

Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.19140 of 2017 (4) dt.06-07-2017 petitioner no.1 is the mother, petitioner no.2 is the Bhabhi and petitioner no.3, 4 and 5 are brothers of Nirmal Mandal. There is no allegation against them and further for the action of the Nirmal Mandal, the entire family cannot be roped in the criminal case. Looking to the entire facts and circumstances of the case, let the petitioners, namely, Sudha Devi, Kavita Devi, Nakul Mandal, Pravesh Mandal and Sarvesh Mandal, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Nagar P.S. Case No. 30 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
