2. The petitioner seeks bail in connection with Naugachia P.S. Case No. 388 of 2022 registered for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is the assailant of the deceased.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 24.01.2023 he is quite innocent and has not committed any offence.

5. Learned A.P.P. has vehemently opposed the prayer for bail and has submitted that the petitioner has two criminal antecedents.

6. Considering the allegations levelled against the petitioner, I am not inclined to grant bail to the petitioner.

7. This application is dismissed.

8. The Court below is directed to expedite the trial of the petitioner.
