Despite valid service of notice, nobody appears on behalf of the State.

The petitioner seeks pre-arrest bail in connection with Khagaria (Chitragupta Nagar) P. S. Case No. 41 of 2017 registered under Sections 323, 380, 420, 467, 468, 471/34 of the Indian Penal Code.

It is contended that the FIR has been instituted on the basis of the complaint which was referred to the police for investigation under Section 156(3) of the Code of Criminal Procedure. It is contended that the ingredients of the offence alleged are not attracted in the present case. It is contended that

Considering the nature of the offence and the submissions made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in Khagaria (Chitragupta Nagar) P. S. Case No. 41 of 2017, subject to the conditions as laid down under Section 438
