The petitioner seeks bail in Sonepur P.S. Case No. 576 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.
As per the prosecution case, on the alleged date and time of occurrence, while the informant along with his wife was going to his sasural on motorcycle, on the way, four miscreants riding on two motorcycles intercepted him and on the point of pistol, took away the key of motorcycle and snatched golden chain from the neck of his wife. It is further alleged that during course of fleeing away they dropped the key of bike. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, petitioner has been remanded in this case on
Patna High Court CR. MISC. No.56454 of 2021(2) dt.07-12-2021 2/2 07.06.2021 from Hajipur Sadar PS Case No. 509 of 2020 and on his own confession before the police his name surfaced in this case. No incriminating article has been recovered from possession of this petitioner. No test identification parade has been held till date. Petitioner is in custody since 07.06.2021. Chargesheet has already been submitted.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 576 of 2020.
