In this case, the petitioner is apprehending his arrest in connection with Teghra P.S. Case No. 266 of 2016 registered for offences under sections 448, 341, 323, 384, 504, 506, 34 of the Indian Penal Code.

In the present case, the Informant has made an allegation that he has a plot of land measuring 17 Katha having Jamabandi No. 4/14, Khesra No. 7390 at village Daniyalpur Teghra, Ward No. 18. On 30.7.2016, he was cutting 22 tress of Semal, Babul and Sisham standing on his land and replacing with the fruit tree. An allegation has been made that while he was carrying away about 100 pieces of wooden logs on tractor, all the accused persons armed with

Patna High Court Cr.Misc. No.45896 of 2017 (2) dt.10-10-2017 weapons came there and they tried to take away the wood without making any payment for the same.

Learned counsel for the petitioner submits that there is a dispute of title over the land and proceeding under Section 144 Cr.P.C. is going on.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Md. Jasim, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 266 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
