The acquittal was challenged in Criminal Appeal No.35 of 2017. The criminal appeal was heard by the learned 7th Additional Sessions Judge, Muzaffarpur and by the impugned judgment dated 19.07.2018, a finding of conviction has been recorded.

Learned counsel for the petitioner submits that criminal appeal would be maintainable against the judgment of conviction recorded by the court below. Hence, petitioner be permitted to convert this criminal revision into criminal appeal. Learned counsel for the opposite party does not oppose the prayer.

Prayer is allowed.
