Petitioner seeks bail in connection with Uchkagaon Police Station Case No.219 of 2018 registered for the offences punishable under Sections 376(2) of the Indian Penal Code and Sections 3/4, 5(m)(n)/6 of the POCSO Act, 2012 pending in the court of learned 1st Additional Sessions Judge, Gopalganj. Allegation against the petitioner is that he ravished to 10 years old daughter of the informant by committing house trespass. The victim has also supported the allegation in her statement recorded under Section 164 of the Code of Criminal Procedure.
Submission is that false implication is there due to dispute relating to family property. Petitioner is agnate of the
Patna High Court CR. MISC. No.44040 of 2019(3) dt.26-09-2019 2/2 informant.
Considering the nature of allegation, I am not inclined to enlarge the petitioner, above named, on bail. Hence, prayer is refused.
The learned trial court is directed to expedite the trial.
