JUSTICE SATYAVRAT VERMA ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner and Shri Ramchandra Sahni, learned A.P.P. for the State. The petitioner seeks bail in connection with Begusarai Town P.S. Case No. 215 of 2021 instituted for the offences under Sections 399, 402 and 120B of the Indian Penal Code read with Sections 25(1-B)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 15.03.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that allegation is of recovery of a live cartridge and a Samsung mobile from the petitioner and from the other co-accused persons, arms and cartridges were recovered.

Learned counsel for the petitioner submits that

No.56448 of 2021(2) dt.23-02-2022 2/2 admittedly from the petitioner only one live cartridge has been recovered and cartridge without gun is useless as such the petitioner has been falsely implicated only because he may be present at the place of occurrence with the accused from whom arms and cartridges were recovered.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 15.03.2021, charge-sheet has been submitted in the case and allegation is of recovery of live cartridge and a Samsung mobile, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Sandeep Chaitanya, learned J.M. 1st Class, Begusarai in connection with Begusarai Town P.S.
