The petitioner is not named in the first information report and he has been made accused in this case on the ground that in course of investigation, allegedly looted mobile was recovered from his conscious possession but submission on behalf of the petitioner is that the looted mobile was not recovered from conscious possession of the petitioner and as a matter of fact, one Sim of Airtel company was seized from possession of the petitioner though in the present case, a Sim, relating to reliance company was looted. It is further contended by him that the learned court below has committed error in the impugned order by mentioning that the looted mobile had been used by the petitioner.
