The petitioner has prayed for bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

As per allegation in the FIR, while the informant was returning to Bagaha after collecting Rs. 1,53,525/- and reached near Bhobaha pool, two miscreants overtook his motorcycle and one of them, looted his entire amount and biometric machine on gun point.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is innocent. He is not named in the FIR nor put on TIP. Nothing

Patna High Court CR. MISC. No.47082 of 2022(3) dt.16-02-2023 2/2 has been recovered from his conscious possession. During investigation, no any cogent material has come against the petitioner to implicate him in the present case. Chargesheet has been submitted u/s 392 IPC. Petitioner is languishing in judicial custody since 07.03.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Bagaha, West Champaran in connection with Valmikinagar P.S. Case No. 61 of 2020.
