JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Amba P.S. Case No.88 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The learned counsel for the petitioner submits that the petitioner is in custody since 12.07.2021 and charge-sheet has been submitted in this case and allegation is of recovery of 620.007 litres of liquor out of which 79.500 litres is alleged to be recovered from the petitioner from two Tempo along with vehicle.
The learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.56388 of 2021(2) dt.07-01-2022 2/2 the petitioner is the driver of the Tempo, as such, was not knowing what passenger had kept in the Tempo. Learned A.P.P. opposes the bail application.
Considering the fact that petitioner is in custody since 12.07.2021 and charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.2,000/- (Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Aurangabad, in connection with Amba P.S. Case No.88 of 2021.
The application stands allowed.
