ANSARI ORAL ORDER 20-01-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, Seeking bail by the petitioners, namely, Uddin Mian, in connection with Chakai Police Station Case No. 43 of 2014, under Section 302/34 of the Indian Penal Code.

Perused the above application and materials on record. Also perused the relevant case diary. Heard Mr. Satya Prakash Parasar, learned Counsel, appearing on behalf of the petitioner, and Mr. Shantanu Kumar, learned Additional Public Prosecutor, appearing on behalf of the State.

Considering the fact that there are serious incriminating materials available in the case-diary against the accused-petitioner, this Court is of the view that at

Patna High Court Cr.Misc. No.38770 of 2014 (3) dt.20-01-2015 2/2 this stage of investigation, the accused above-named cannot be allowed to go on bail.

In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. This Bail application shall stand disposed of accordingly.
