JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-01-2015 The petitioner had submitted an application for mutation of a piece of land pertaining to Mauza Sipah, P.S.-Deepnagar, District-Nalanda. After receipt of the said application an enquiry was conducted into the matter. In course of enquiry the revenue clerk reported that the land in question was a disputed land. The Circle Inspector, Biharsharif recommended for rejection of the mutation application of the petitioner. In view of the enquiry report, the Circle Officer, Biharsharif rejected the mutation application of the petitioner.

The petitioner being aggrieved with the order of the

Patna High Court Cr. WJC No.1152 of 2013 (3) dt.13-01-2015 2/2 Circle Officer, Biharsharif has filed an appeal vide Misc. Appeal No.20 of 2013 before the D.C.L.R., Biharsharif which is pending for adjudication.

By filing the present application under Articles 226 and 227 of the Constitution of India, the petitioner has prayed for issuance of a writ in the nature of mandamus commanding the respondents to initiate action against the Circle Officer, Biharsharif, Nalanda. Apparently, the application seems to be misconceived and malicious.

In that view of the matter, I am not inclined to entertain the present application.

Accordingly, the writ petition is dismissed.
