The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case, in short, is that while the informant was making cow dung , the accused persons came and started abusing and assaulting her due to which she sustained injuries.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The manner of occurrence as alleged in the F.I.R.
Patna High Court Cr.Misc. No.51989 of 2018(4) dt.14-12-2018 2/2 itself appears to be unprovable.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R. He is alleged to have caused fire arms injury upon the victim.
Considering the above, I am not inclined to grant anticipatory bail to the petitioner. Prayer is rejected. However, if the petitioner surrenders and prays for bail in the Court below, the same shall be considered on its own merit without being prejudiced by this order.
