JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-07-2019 The present modification petition has been filed for modifying the order dated 29.05.2019 passed in CWJC No. 11740 of 2019 whereby and whereunder the petitioner had been permitted to withdraw the writ petition with liberty to approach the District Teachers Employment Appellate Authority, Jamui. It

Patna High Court MJC No.2484 of 2019(3) dt.17-07-2019 2/2 is submitted that the District Teachers Employment Appellate Authority, Jamui is not functioning at the moment. This Court by an order dated 04.07.2019 had sought information from the respondents about the aforesaid statement made by the learned counsel for the petitioner, whereupon an affidavit has been filed and it has been stated that the Member/Presiding Officer of the said Appellate Authority has retired in the month of May, 2019 and it is expected that concerned Member/ Presiding Officer shall be posted at an early date.

Having regard to the submission made by the learned counsel for the parties, this Court finds that no definite date has been furnished by the respondents regarding posting of the Member/ Presiding Officer, hence this Court deems it fit and proper to recall the order dated 29.05.2019 passed in CWJC No. 11740 of 2019 and directs that the said writ petition be listed for hearing before the appropriate Bench immediately. The modification petition stands disposed of on the aforesaid terms.
