2. The petitioner has preferred this application for grant of regular bail in connection with GRP Patna Junction P.S. Case No. 51 of 2025 dated 21.01.2025 registered for the offences punishable u/ss 303(2), 317(2), 317(5), 111 and 112 of the B.N.S.
3. As per the prosecution case, the informant is alleged that on 21.01.2025, three persons suspiciously were talking with each other at the western side of a railway platform. On seeing the police party, they started to flee away but they were apprehended and disclosed their names as Vikash Kumar, Karan @ Balajee and Rakesh Kumar (petitioner). No.47509 of 2025(3) dt.27-08-2025 2/3 blade were recovered from the possession of the co-accused, Vikash Kumar, one mobile phone was recovered from the possession of the co-accused, Karan @Balajee and one mobile phone was also recovered from the possession of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The charge-sheet has been submitted against the petitioner. The petitioner has five criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 22.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, R.J.M., Patna, District- Patna in connection with GRP Patna Junction P.S. Case No. 51 of 2025 with the condition

No.47509 of 2025(3) dt.27-08-2025 3/3 :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
