Petitioner seeks bail in a case registered for the offence punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is to have fired upon the informant which hit right side of his abdomen, as a result of which, he sustained grievous injury.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. On the other hand, learned APP submits that the doctor has found a large penetrating wound on the person of the informant, i.e., severe bleeding over right side umbilical region measuring 10 c.m. X 6 c.m. X deep undetermined size with no exit wound, which is grievous in nature, caused by bullet gun

Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
