2. The petitioner is in custody in connection with N.T.P.C. P.S. Case No. 65 of 2023 for the offence punishable under Sections 341, 323, 307, 324, 326, 379, 504, 506 and 34 of the Indian Penal Code lodged on 28.04.2023 by the informant, Awadhesh Singh.

3. As per the prosecution story, the informant alleged that while he was irrigating his maze field, the accused persons came, armed variously, demanded extortion and upon protest, this petitioner gave iron rod blow on the head causing injuries. There is further allegation of snatching of gold chain etc. Accordingly, the FIR.

4. Learned counsel for the petitioner submits that the informant was first taken to the Primary Health Center, Barh

Patna High Court CR. MISC. No.52391 of 2024(2) dt.19-07-2024 2/2 and then to P.M.C.H. Patna and he was conscious, still no further statement was made.

5. Learned APP on the other hand has taken this Court to the supplementary injury report to show that there was fracture in the skull and the injury was found to be grievous in nature.

6. There is direct allegation against the petitioner of assaulting on the head, causing grievous injury and in that background, this Court is not inclined to extend him privilege of bail.
