JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Section 3 of RP (UP) Act. Petitioner's name was disclosed by co-accused who was apprehended with stolen railway property. Learned counsel for the petitioner submits that save and except the aforesaid confessional statement of co-accused, no other tangible evidence has been collected during course of investigation against the petitioner. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel for the State opposes the prayer for bail submitting that the petitioner has got criminal antecedent of similar nature.

Considering the aforesaid facts, prayer for bail of the

Patna High Court CR. MISC. No.48446 of 2022(2) dt.28-09-2022 2/2 petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
