JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-04-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner happens to be husband of the deceased who died within two years of her marriage in mysterious circumstances. There is allegation of demand of dowry as well as torturing.

Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Shikarpur P.S. Case No. 95 of 2014 pending in the court of Chief Judicial Magistrate, West Champaran, Bettiah stands rejected.

Patna High Court Cr.Misc. No.38853 of 2014 (4) dt.02-04-2015 However, learned Chief Judicial Magistrate, West Champaran, Bettiah should commit the case of the petitioner to the court of Sessions in accordance with law within three weeks from the date of receipt/production of copy of this order and after commitment, the concerned Sessions court shall expedite the trial of the petitioner and try to conclude the same as early as possible.
