The petitioner is accused in connection with Town P.S. Case No. 397 of 2020 registered under sections 25(1-b)A, 26, 35 of the Arms Act I.P.C. pending in the Court of C.J.M., Muzaffarpur.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Petitioner is in custody since 06.07.2020. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner has criminal antecedent. The witnesses have also

Patna High Court CR. MISC. No.3098 of 2021(2) dt.15-03-2021 2/2 supported the prosecution case. Hence, the petitioner does not deserve to be enlarged on bail.

Having considered the above facts and circumstances of the case and nature of allegation, this Court is not inclined to allow the prayer of the petitioner for bail. Accordingly, prayer for grant of regular bail of the petitioner is rejected. However, liberty is granted to the petitioner to renew his prayer for bail after framing of charge.
