The petitioner seeks bail in connection with Adapur P.S. Case No. 176 of 2023 instituted for the offence under Sections 420, 489(A), 489(B), 489(C) & 34 of the Indian Penal Code.

As per the prosecution story, on 09.06.2023 the informant got information that one person from Sirisiya Kala is coming with counterfeit currency at Adapur. On this information, the informant along with other police personnel reached there and the said person got apprehended and from his possession, counterfeit currency was recovered. The apprehended accused disclosed that he had taken this counterfeit
Patna High Court CR. MISC. No.45457 of 2025(4) dt.22-09-2025 2/3 currency from one Abid Ansari (petitioner) and Ful Mohammad Ansari and was going to Adapur to exchange it with the original currency.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 02-04-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel submits that on the basis of alleged confessional statement of the apprehended accused person, petitioner is roped in this case. The apprehended accused has made statement that he got counterfeit currency from petitioner and Ful Mohammad and was going to Adapur to exchange it with original currency. Charge sheet has already been submitted in this case. Learned counsel mainly submits that similar situated co-accused, namely, Ful Mohammad has been enlarged on anticipatory bail by a Co-ordinate Bench of this Court vide order dated 31-01-2024, passed in Cr. Misc. No. 1508 of 2024. 6.
Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.45457 of 2025(4) dt.22-09-2025 3/3 of the case, period of custody of the petitioner, claim based on parity and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Adapur P.S. Case No. 176 of 2023.
