Having regard to the nature of allegation against the petitioner for the offences punishable under Sections-414 and 401/34 of the Indian Penal Code and the fact that there is recovery of the stolen mobile phone from the possession of the petitioner and that he has also two more similar cases pending against him, is sufficient to reject the prayer for bail of the petitioner. Keeping however in view of the fact that the petitioner has remained in judicial custody since, 27.02.2013 i.e. for a period of almost two years, this Court would direct the trial Court to ensure that the trial of the petitioner is concluded within a period of six months from the date of receipt of this order.
