Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code.

Petitioner is father of co-accused, Mahesh Kumar who allegedly kidnapped to the minor daughter of the informant for the purpose of marriage.

Submission is that petitioner has been falsely implicated and petitioner would try to trace out the victim girl within a month of his release and shall produce her before the Court.

Considering the aforesaid undertaking of the petitioner, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.45378 of 2019(2) dt.25-07-2019 2/2 provisional bail for two months from the date of release on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Tekari (Panchanpur O.P.) Police Station Case No.76 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

The provisional bail shall be confirmed by the learned court below, if the petitioner would produce the victim girl or if the victim girl otherwise appears before the court below.
