Learned counsel appearing on behalf of the petitioner submits that the petitioner had retired from the post of Upper Division Assistant, Road Construction Department, Government of Bihar on 29.02.1996. However, due to mishappening in his family and death of the family members in an accident, petitioner went mentally disturbed and the authority also did not take care to take steps for making payment of retiral dues of the petitioner.

3. The petitioner seeks to file detail representation before the Chief Engineer (North), Road Construction Department, Government of Bihar, respondent no. 3 with respect to the relief claimed in the present writ petition.

4. It is admitted that several queries were made by the Accountant General, Bihar and the same has been brought on record by way of Annexures B1 to B3.

5. The Chief Engineer (North), Road Construction Department, Government of Bihar is directed to call for the service records relating to the petitioner, from the office where the petitioner had worked and retired, to expedite for payment.

6. The Chief Engineer (North), Road Construction Department, Government of Bihar for making payment of

Patna High Court CWJC No.10536 of 2023 dt.10-08-2023 3/3 retiral dues to the petitioner may direct the competent authority to sanction the pension of the petitioner to be fixed by the Accountant General, Bihar.

7. The petitioner, if so desire, may also appear before the Engineer-in-Chief (Headquarters), Road Construction Department, Government of Bihar as and when required in any case. The representation of the petitioner and the admissible dues is required to be paid to the petitioner within a period of six weeks with statutory interest.

8. In case of further delay, the petitioner may take appropriate legal action against the Chief Engineer (North), Road Construction Department, Government of Bihar.

9. With the above observation and direction the writ petition stands disposed of.
