JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bikramganj P.S. Case No. 86 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 153, 153A, 295, 295A, 337, 338, 353, 332, 435, 379, 427 and 120B of the Indian Penal Code.

Prosecution case is that police got an information that members of mob were damaging the vehicle and also pelting stones and trying to disturb the communal harmony and thereafter police reached there but the mob attacked the police party, causing injuries to some of the police personnel. Petitioner is not named in the FIR but later on his name appeared in this case on the basis of the fact vehicle of petitioner was found there.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.44643 of 2019(2) dt.19-07-2019 2/2 that he has falsely been implicated only because his vehicle was there and he was not present at the place of occurrence. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Bikramganj P.S. Case No. 86 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation and appear before the police as and when required, otherwise his bail bonds shall be cancelled.
