=========================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date: 20-03-2017 Keeping in view the order dated 08.11.2016, passed in L.P.A. No. 692 of 2014, setting aside the order passed in connected writ application being Civil Writ Jurisdiction Case No. 13860 of 2012 cancelling the entire appointment and selection process, it is not a fit case where the appointment can be granted to the applicants, merely because the L.P.A. filed by the State Government was dismissed on technical ground for want of prosecution, in view of the order passed

Patna High Court MJC No.3997 of 2013 dt.20-03-2017 2/2 in L.P.A. No. 692 of 2014, the entire selection process is found to be vitiated. It is not appropriate to issue any direction for appointment in this contempt proceeding.

Accordingly, this application is disposed of. In case, due to dismissal of Letters Patent Appeal against the order passed by the Writ Court, in case of the present applicants are entitled to any benefit they are free to initiate fresh proceeding in accordance with law. The application is disposed of.
