The petitioners apprehend their arrest in Paharpur P.S. Case No. 16 of 2017, registered for the offences punishable under Sections 341, 323, 327, 379, 420, 466, 467, 471 and 120B of the Indian Penal Code and Sections 9/10 of the Child Marriage Restrained Act.

Learned counsel for the petitioners submits that the informant has earlier lodged Motihari Town P.S. Case No. 588 of 2016 for kidnapping of his daughter against the petitioners and others. The daughter of the informant made her statement under

Section 164 of the Code of Criminal Procedure and she disclosed that she voluntarily solemnized marriage with Sanjiv Kumar Jha. Thereafter, the police submitted final form finding the case false in Motihari Town P.S. Case No. 588 of 2016. The informant thereafter filed the Complaint Case No. 107 of 2017 on the basis of which the present FIR was registered. It is further submitted that from perusal of the complaint petition, it would appear that the informant made allegation that his daughter was minor but interpolation was made in her birth certificate and the informant got apprehension that the accused persons may file suit against him.

It appears that the daughter of the informant voluntarily left her house and solemnized marriage with Sanjiv Kumar Jha and the petitioners are relatives of Sanjiv Kumar Jha. Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East

Champaran at Motihari in Paharpur P.S. Case No. 16 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
