2. The present application has been filed for cancellation of the anticipatory bail granted to Opposite Party Nos. 2 and 3 vide order dated 14.06.2018 passed in A.B.P. No. 3190 of 2018 by the learned District & Additional Sessions Judge-XI, Patna, in connection with Complaint Case No. 3582 of 2017.

3. Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.59233 of 2018(7) dt.23-07-2026 2/3 submits that after being granted the privilege of anticipatory bail, Opposite Party Nos. 2 and 3 have violated the conditions imposed by the learned court and have indulged in acts which constitute sufficient grounds for cancellation of the bail granted in their favour. It is, therefore, prayed that the anticipatory bail granted to Opposite Party Nos. 2 and 3 be cancelled.

Having considered the submissions advanced on behalf of the parties and taking into account the nature of allegations made in the present application, this Court finds that the grounds sought to be urged for cancellation of bail involve disputed questions of fact, which are required to be examined by the court which had granted the privilege of anticipatory bail.

5. Accordingly, without expressing any opinion on the merits of the allegations or the defence of the parties, the present application stands disposed of with liberty to the petitioner to approach the court concerned by filing an appropriate application for cancellation of anticipatory bail on the grounds raised in the present proceedings.

6. In the event of filing of such an application, the court concerned shall consider and dispose of the same in accordance with law, preferably within a period of fifteen days from the date of filing of such application.
