JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 06-07-2017 Heard learned counsel for the petitioner. Despite repeated calls, nobody appears on behalf of the State. The petitioner seeks pre-arrest bail in connection with K. Hat P.S. Case No. 635 of 2015 registered for the offences punishable under Sections 341, 323, 504, 506 and 384 of the Indian Penal Code.
Considering the fact that on completion of investigation the police submitted charge-sheet under Sections 341, 323 and 506 of the Indian Penal Code only and the learned Magistrate differing with the police report took cognizance of the
Patna High Court Cr.Misc. No.21214 of 2017 (2) dt.06-07-2017 2 / 2 offence under Sections 341, 323, 504 and 384 of the Indian Penal Code as also the fact that the petitioner happens to be own brother of the informant of the case and has got roots in the society, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat P.S. Case No.635 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender within a period of six weeks from today.
