The petitioner seeks bail in a case registered under Sections 341, 323, 307, 354(B)/34 of the Indian Penal Code and 12 of POCSO Act.
Allegedly, the petitioner with other accused forcibly dragged the daughter of the informant from the Auto and on objection, they brutally assaulted the passengers of the Auto. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-02-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. General and omnibus allegation
Patna High Court CR. MISC. No.48509 of 2019(2) dt.06-08-2019 2/2 has been made against the petitioner. No specific injury is attributed against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.Istcum-Special Judge (POCSO), Patna in connection with Special Case No. 35 of 2019 arising out of Bihta P.S. Case No. 222 of 2019.
