JUSTICE ALOK KUMAR SINHA ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 23-09-2025 The State-appellant has assailed the order of learned Single dated 28.06.2021 passed in CWJC No. 7902 of 2020 (Sanjay Kumar & Ors. vs. State of Bihar & Ors.).

Core issue involved in the present lis is whether respondents are entitled to count service rendered in the District Teachers Training Institute or Organization for the purpose of certain service benefits. Admittedly, there is no policy or statutory rules which provides for counting service rendered by teachers in the District Teachers Training Institute or Organization. The same has not been appreciated by the learned

Patna High Court L.P.A No.550 of 2021(13) dt.23-09-2025 3/3 Single Judge. So also, the contesting respondents herein, in the absence of vested right to claim any service conditions, respondents have no right to claim any benefits.

3. In the light of these facts and circumstances, read with the Co-ordinate Bench decision in LPA No. 685 of 2021 dated 08.07.2024 (Arun Kumar & Ors. vs. State of Bihar & Ors.) which is aptly applicable to the case in hand.

4. Accordingly, the State appellants have made out a case so as to interfere with the order of learned Single Judge dated 28.06.2021, and it is set aside. Resultantly, CWJC No. 7902 of 2020 is rejected and the present LPA No. 550 of 2021 is allowed.

5. Pending Interlocutory Application(s), if any, stand disposed of.
